LMIA Advertising Proof Requirement Reinstated Effective January 1, 2026

Starting January 1, 2026, employers applying for a Labour Market Impact Assessment (LMIA) to hire temporary foreign workers in primary agriculture positions under the Temporary Foreign Worker (TFW) Program will once again be required to submit proof of advertising as per the Government of Canada.

Transition Period Extended

To support a smooth transition, the temporary suspension of minimum advertising requirements for these positions has been extended until December 31, 2025 (previously set to end June 30, 2025). This means employers do not need to include proof of job advertisements with LMIA applications submitted on or before December 31, 2025.

Advertising Requirements (Effective 2026)

Starting January 1, 2026, employers will need to:

  • Advertise the job for at least 14 calendar days.
  • Ensure the job ad is accessible to the general public.
  • Post the ad within the three months prior to submitting the LMIA application.
Ongoing Recruitment Expectations

While proof of advertising is not currently required, employers are still expected to actively recruit Canadians and permanent residents, particularly those from underrepresented groups in the labour market, including:

  • Vulnerable youth
  • Indigenous peoples
  • Newcomers to Canada
  • Persons with disabilities
  • Asylum seekers with valid work permits
Recordkeeping for Inspections

Even during the suspension period, employers must retain documentation of their recruitment efforts. These records may be requested during a compliance inspection and should demonstrate ongoing efforts to hire from within the domestic labour market.
